  1. DECISION ON IMPLEMENTATION OF ARTICLE XXIV:2 OF 
  2. THE AGREEMENT ON GOVERNMENT PROCUREMENT

  5. 1.    Ministers invite the Committee on Government Procurement to clarify 
  6. that:
  7.  
  8.       (i)  a Member interested in accession according to Article XXIV:2 
  9.            would communicate its interest to the Director-General, 
  10.            submitting relevant information, including an offer by way of a 
  11.            list of entities having regard to the relevant provisions of the 
  12.            Agreement, in particular Article I and, where appropriate, 
  13.            Article V;

  15.       (ii) the communication would be circulated to Parties to the 
  16.            Agreement;
  17.  
  18.       (iii)the Member interested in accession would hold consultations with 
  19.            the Parties on the terms for its accession to the Agreement;
  20.  
  21.       (iv) with a view to facilitating accession, the Committee would 
  22.            establish a working party if the Member in question, or any of 
  23.            the Parties to the Agreement, so requests.  The working party 
  24.            should examine:  (a)  the offer made by the applicant Member;  
  25.            and  (b)  relevant information pertaining to export opportunities 
  26.            in the markets of the Parties, taking into account the existing 
  27.            and potential export capabilities of the applicant Member and 
  28.            export opportunities for the Parties in the market of the 
  29.            applicant Member;

  31.       (v)  upon a decision by the Committee agreeing to the terms of 
  32.            accession including the list of entities, the acceding Member 
  33.            would deposit with the Director-General of the MTO an instrument 
  34.            of accession which states the terms so agreed.  Until the entry 
  35.            into force of the Agreement Establishing the MTO, the instrument 
  36.            would be deposited with the Director-General to the CONTRACTING 
  37.            PARTIES to the GATT.  The text of the acceding Member's list of 
  38.            entities in English, French and Spanish would be annexed to the 
  39.            Agreement.

  41. 2.    It is noted that the Committee decisions are arrived at on the basis 
  42. of consensus.  It is also noted that the non-application clause of Article 
  43. XXIV:11 is available to any Party.
